Permits

  • Permits are handled by the Millburn Construction Code Enforcing Agency, led by the Construction Official. A construction permit is good for one year from the day it’s issued. Source: Millburn Code: Construction Code
  • Under N.J.A.C. 5:23-2.15(f), an addition or alteration to an owner-occupied one- or two-family home needs zoning approval in place before the construction plans are reviewed. Source: N.J.A.C. 5:23-2 (NJ DCA)

Historic review

  • Millburn has two historic districts: the Short Hills Park Historic District and the Wyoming Historic District. Source: Millburn Code, Art. 8 (§§ 804-805)
  • In those districts, a Certificate of Appropriateness from the Historic Preservation Commission is needed before any exterior change, addition, new building, demolition or move, even when the work doesn’t need a construction permit. Source: Millburn Code, Art. 8 (§§ 804-805)
  • No certificate is needed for interior work, repainting surfaces that are already painted, structural repairs that don’t change the outside, or changes that can’t be seen from a public street. Demolition and moving a building always need one. Source: Millburn Code, Art. 8 (§§ 804-805)
  • Minor items such as windows, doors, roofing and fences can be approved by the Commission’s Minor Work Review Committee without a public hearing. Source: Millburn Code, Art. 8 (§§ 804-805)

Flood zones

  • In Millburn’s special flood hazard areas, a Development Permit from the Township Engineer is needed before construction starts. Work costing more than half the building’s market value counts as a substantial improvement. Source: Millburn Code §§ 702, 704

On your job, any permit the work needs is in place before that work starts, and it’s written into your scope. How permits work across both states: remodel permits in NJ and PA.
